Opposition against the bill appointing CEC
The bill to regulate the appointment of the Chief Election Commissioner (CEC) and other Election Commissioners (ECs) was discussed in the Rajya Sabha on August 10. According to the bill, the commissioners will be appointed by a panel of three members. Which will include the Prime Minister, the leader of the opposition in the Lok Sabha and a cabinet minister.

In the Rajya Sabha, Congress, Aam Aadmi Party and other opposition parties had opposed this bill. Opposition parties said- The government is weakening the Supreme Court by bringing the bill against the order of the Constitution bench.

The Supreme Court had said in an order in March 2023 that the CEC should be appointed by the President on the advice of the Prime Minister, Chief Justice of India and the Leader of the Opposition.

Delhi Chief Minister Arvind Kejriwal tweeted and wrote – Through this bill, the government is going to overturn another decision of the Supreme Court. Kejriwal had shared 2 pictures. The first of these is the order of the Supreme Court, which mentions the decision of the Supreme Court given in March 2023. At the same time, there is a document in the second picture, in which it is written that the Prime Minister, the leader of the opposition and the Union Minister nominated by the PM should advise the President for the appointment of CEC, after which the President orders the appointment.

Kejriwal said- PM will be able to make any person of his choice as CEC.
Kejriwal said in the tweet- Prime Minister does not believe in the Supreme Court of the country. His message is clear that whatever order of the Supreme Court he does not like, he will bring a law in the Parliament to overturn it. If the PM does not openly accept the Supreme Court then it is a very dangerous situation.

The Supreme Court had formed an impartial committee. By overturning the Supreme Court order, Modi ji has formed a committee which will be under his control. He will be able to appoint the person of his choice as the Election Commissioner. This will affect the fairness of the elections.

Supreme Court had decided to have CJI in the panel, 3 important comments

  1. The Supreme Court had given a historic verdict on March 2 on the appointment of the Chief Election Commissioner and Election Commissioners. The court had ordered – the panel of PM, Leader of Opposition in Lok Sabha and CJI will appoint him. The 5-member bench said that this committee will recommend the names to the President. After this the President will put his seal of approval.
  2. The Supreme Court said that this process will remain in force until the Parliament makes any law regarding the appointment of election commissioners. The selection process should be on the lines of CBI Director.

The power of vote is supreme, even the strongest parties can lose power through it. It is necessary for the Election Commission to be independent. Before the Supreme Court’s decision, the entire process of appointment of election commissioners was in the hands of the central government.
