The troubles of Asaram, who is lodged in Jodhpur’s Central Jail for the last 10 years in the case of raping a minor, are not decreasing. The Supreme Court on Tuesday (September 12) refused to hear Asaram’s bail plea. The top court has clearly said that Asaram can go to the High Court for suspension of the sentence.
Asaram has tried for bail 16 times so far, from Lower Court to Rajasthan High Court, Supreme Court and Gujarat High Court. He has got bail only once in the fake medical certificate case. Even in that he cannot come out of jail.
Had gone to the Supreme Court in the matter of POCSO Act, but here too the decision was not in favor.
This is what the Supreme Court said
Asaram, who failed to get bail from Rajasthan and Gujarat High Court, is now knocking on the doors of the Supreme Court. A few months ago, Asaram got bail from the Supreme Court in the fake medical certificate case. After this, he approached the Supreme Court to get bail in the POCSO Act case also. On Tuesday, the Supreme Court clearly refused to hear. The court said- If his appeal against the sentence is not heard promptly by the trial court, Asaram can file a petition in the Rajasthan High Court for suspension of the sentence.
POCSO court has sentenced
The SC-ST Court and POCSO Court of Jodhpur had sentenced Asaram after a trial of about 4 years. Asaram was sentenced to life imprisonment on 25 April 2018. Two of his servants were also found guilty and sentenced. This appeal is pending in Jodhpur High Court. Asaram has already tried to get bail from Jodhpur High Court, but it was rejected every time.
Asaram has filed bail petitions several times. His petition is rejected again and again.
Bail was granted on fake medical certificate
Asaram had presented a fake medical certificate of Jodhpur Central Jail Dispensary in the Supreme Court in 2017. In this, several diseases were cited and bail was demanded. When the Supreme Court got this medical certificate examined, it was found to be fake. After this a separate episode started in this regard. He was granted bail in this case in April this year. Despite that he could not come out of jail.
Even Gujarat High Court did not grant bail
Another minor girl in Gujarat had filed a case against Asaram under the POCSO Act. In this case, Asaram has tried to get bail from Gujarat High Court. A bail petition was filed in October 2022, but it was rejected.
The girl was raped in the ashram of Jodhpur.
Asaram had raped a minor girl at Manai Ashram in Jodhpur between 15-16 August 2013. FIR number zero was registered in Delhi on 20 November. On 31 August 2013, Jodhpur Police team reached Indore (Madhya Pradesh) to arrest him. The team reached Jodhpur with him on 1 September 2013. Since then he is lodged in Jodhpur Central Jail.
